International airlines are not bound by SA’s race-based licensing, says court

Business organisation Sakeliga challenged attempts by SA authorities to 'smuggle' BEE requirements into licensing regimes.
International airlines may not be subject to BEE and other race-based rules when applying for licenses to operate in SA, the Pretoria High Court ruled on Friday.
Business organisation Sakeliga took the matter to court after being alerted by foreign embassies that international airlines were being unlawfully required to adhere to local BEE laws and processes when this was not required under SA’s International Air Services Act.
